Content Rights and Commercial Use

What rights you keep in uploaded material, how generated output may be used, and where AI output rights remain uncertain.

WhimKid is a tool for turning an idea into an editable children's storybook. This page explains the rights model in plain language. It supplements the Terms of Service; if the two documents conflict, the Terms control.

This page is general product information, not legal advice. Copyright, publicity rights, privacy rights, and rules for AI-generated material differ between jurisdictions. WhimKid does not promise that a particular output is protected by copyright or cleared for every possible use.

Your uploaded material remains yours

You keep the rights you already have in text, photographs, drawings, character descriptions, voice recordings, and other material that you upload. Uploading material does not transfer ownership to WhimKid.

To operate the service, you grant WhimKid a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit, display, and adapt your material as needed to provide the requested workflow. This includes generating a script, creating illustrations, producing narration, saving edits, displaying your book in the account, and preparing exports. The licence also allows the technical processing needed to secure, maintain, debug, and improve the service. We do not use uploaded images or story content to train our own machine learning models.

You are responsible for making sure that you have the rights and permissions needed for every item you upload. This includes permission to use a child's photograph, another person's artwork, a trademark, a real person's name or likeness, and any music or recording that you provide.

Generated text and illustrations

Subject to the Terms of Service and restrictions that apply to the AI providers involved, WhimKid permits you to use the generated text and illustrations, including for commercial projects. You can edit the story, adjust pages, regenerate selected illustrations, create supported exports, and use the result in a project that complies with the law and the applicable provider terms.

Generated output can resemble existing styles, contain mistakes, include unintended details, or be similar to material created for someone else. Review every page before publishing, selling, distributing, or showing a book to children. Do not assume that a generated name, character, logo, likeness, quotation, or visual element is cleared for use.

WhimKid does not grant exclusive rights in generated output and does not guarantee copyright protection. In some jurisdictions, human creative contribution can affect whether and how copyright protects a result. The answer can depend on the prompts, edits, selection and arrangement of elements, and the law applied to the specific work.

If you need exclusive ownership, registration, clearance, or a legal opinion, have a qualified lawyer review the work and its creation history. Keep drafts, edits, source materials, and export records that help show your human contribution and your permission to use inputs.

Children's likenesses and personal material

Only upload a child's photo or likeness when you have the necessary permission. Do not use a generated likeness to mislead, defame, sexualise, harass, or harm a child or any other person. The person operating the account is responsible for reviewing the result and choosing where it is shared.

The rights to a photograph and the rights of publicity or privacy in a person's likeness can be separate questions. A parent or guardian's permission to upload a photo does not automatically make every later use lawful in every location. Follow the rules that apply where the person lives and where the book will be published.

Sharing, exports, and takedowns

You control whether to create a share link. Share links can have passwords, expiry dates, and revocation. Anyone who obtains a valid link and password may view the book, so check the book before sharing it.

Exports are generated for you to keep and use within the limits described above. If you discover that you uploaded material without permission, delete it from the account when possible and contact support@whimkid.com. If you believe a book infringes your rights, include the relevant URL or account details and explain the issue. We may restrict access or remove content while we review a report.

WhimKid-owned material

The WhimKid name, logo, software, interface, site design, documentation, and other materials supplied by WhimKid remain owned by WhimKid or its licensors. You may use your book and permitted exports; that permission does not give you a licence to copy or resell the WhimKid service, branding, interface, or proprietary documentation.

Practical checklist

Before publishing a book, confirm that you:

  1. Own or have permission to use every uploaded image, text, recording, and likeness.
  2. Have permission to use a child's photograph and have reviewed the generated depiction.
  3. Removed private details that the book does not need.
  4. Checked names, logos, quotations, and visual elements for accidental similarity.
  5. Kept a copy of the source material, edits, and the final export.
  6. Reviewed the current Terms and relevant AI provider restrictions for the planned use.

Common content rights questions

Who owns the content I upload?
You keep the rights you already have in text, images, photographs, and other material you upload. You give WhimKid a limited licence to store, process, transmit, and display that material to operate the service.
Can I use WhimKid output commercially?
Our Terms allow commercial use of generated text and illustrations, subject to the Terms and any applicable restrictions from the AI service providers involved.
Do I receive exclusive copyright in AI-generated output?
WhimKid does not promise exclusivity or copyright protection for AI-generated output. Copyright treatment varies by jurisdiction and may depend on human authorship and other facts.
Can I edit and export my book after generation?
Yes. The product supports editing story text, page order, layout, and selected illustrations after generation. You can export supported versions for personal or permitted commercial use.
Can I use a child’s likeness in a generated book?
Only when you have the necessary permission and use the result lawfully and responsibly. You must not use a child’s likeness in a misleading, defamatory, sexual, or harmful way.
Does WhimKid own my finished book?
WhimKid does not claim ownership of your uploaded material or the book you create. WhimKid retains ownership of its software, interface, branding, and documentation.
What happens when I share a book?
You remain responsible for the material you share. A share link can expose the book to anyone who obtains the link and any required password, so review the content before sharing it.
